Unless im completely mistaken don't you have the option to fight him if you run out of turns to defeat the priest who meets you by the canyon after you free the refugees from the forced labour camp?

Same here. Waiting the 25 turns out at the Fernatus battle doesn't let you fight D'Kah.

I believe it's available in the demo too because the question wasn't targeted at the beta testers or to the one who pre-ordered.

Pre-order (and beta testers?) only, I believe is correct. Seeing as the demo ends right at the end of the first part of the execution mission.
